1. Agreement to Terms

Welcome to MoodYak. These Terms of Service (“Terms”) govern your access to and use of the website moodyak.com, the waitlist, the blog, and any related services (collectively, the “Service”) operated by MoodYak (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.

3. Description of the Service

The Service currently consists of a landing page, waitlist signup, and a blog with informational content related to mood, emotional wellness, friendship, and related topics. A separate mobile application for iOS is in development and will be subject to its own terms when launched.

4. Waitlist

By joining our waitlist, you agree that we may contact you via email about MoodYak's launch, updates, and related information. You may unsubscribe at any time by contacting us at privacy@moodyak.com. Joining the waitlist does not guarantee access to the mobile application.

5. User-Generated Content

If you post comments on our blog, you retain ownership of your content. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute it on the Service.

You are solely responsible for your content and agree not to post anything that is unlawful, defamatory, obscene, harassing, threatening, discriminatory, or that infringes on the rights of others. We reserve the right to remove any content that violates these Terms or that we deem inappropriate, at our sole discretion.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems
• Interfere with or disrupt the Service or its infrastructure
• Use automated means (bots, scrapers, crawlers) to access the Service, except for standard search engine indexing
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity
• Transmit viruses, malware, or other harmful code
• Collect personal information about other users
• Engage in spam, phishing, or other deceptive practices

7. Intellectual Property

The Service and all its original content (excluding user-generated content), features, branding, and functionality are owned by MoodYak and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our express written permission.

8. AI-Generated Content

Some of our blog posts and images are generated with the assistance of artificial intelligence tools. AI-generated content is labeled where applicable. While we review and curate this content, it is provided for informational purposes only and should not be considered professional medical, mental health, or psychological advice.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by MoodYak. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, MoodYak and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed one hundred US dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless MoodYak, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.

We may update these Terms from time to time. We will post the new Terms on this page and update the “Last updated” date. Material changes will be communicated via email if you are on the waitlist. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
